∙ TravX-R (“TravX-R App”, “we”, “us”, “our”, “travxr.com”) are committed to protecting  and respecting your personal data privacy and complying with data protection  principles and provisions under applicable laws. 

∙ We may collect, process, use and disclose your information when you use these  platforms: www.travxr.com and/or the TravX-R App (together, “TravX-R Platforms”)  and the services offered by TravX-R or third-party sellers (“Vendors”) through TravX-R Platforms (“Services”) as described in this Privacy Policy. “You”, “your” and “Users”  when used in this Privacy Policy includes any person who accesses TravX-R Platforms  or uses the Services. 

∙ This Privacy Policy sets out the basis and terms upon which TravX-R collects,  processes, uses and/or discloses your information that is obtained from you when you  access TravX-R Platforms and/or use the Services. Such information may include  personal information relating to or linked to a specific individual such as name,  residential address, email address or any such information we have requested and you  have provided through TravX-R Platforms (“Personal Information”). 

∙ Please read this Privacy Policy carefully. By visiting TravX-R Platforms, you are  consenting to the collection, processing, usage and disclosure of your Personal  Information as set out in this Privacy Policy. 

Scope of Terms 

∙ TravX-R reserves the right, at its sole discretion, to update, amend or modify any part  of the terms of this Privacy Policy without prior notice, and your continued access of  TravX-R Platforms or use of the Services signifies your acceptance of the updated,  amended or modified Privacy Policy, unless if the changes reduce your rights in which  case, we will ask for your consent. TravX-R will post the changes to or modifications of  this policy on this page and will indicate at the bottom of this page the date on which  this policy was last revised. If you do not agree to all the terms and conditions in this  Privacy Policy and/or any subsequent updates, amendments or modifications thereto,  you must stop accessing or otherwise using TravX-R Platforms and the Services. 

∙ Accordingly, please visit this page if you wish to access and view the current version of  this Privacy Policy. It is your responsibility to regularly check these TravX-R Platforms  to ascertain if there are any changes to this Privacy Policy and to review such  changes. 

∙ In addition, when using the Services, you shall be subject to any additional terms  applicable to such Services that may be posted on the page relating to such Services  from time to time and the Privacy Policy adopted by TravX-R from time to time. All such  terms are hereby expressly incorporated by reference in this policy.

Collection of Information 

∙ We may collect Personal Information about you that you provide to us while using  TravX-R Platforms and information about how you use TravX-R Platforms including  when you open your account (“Account”), visit TravX-R Platforms or make purchases  for any intended Services or products (“Services or Products”). Providing your Personal  Information to TravX-R is always on a voluntary basis. However, we might not be able  to process your purchases of certain Services or Products if you choose not to give us  your Personal Information. For example, we cannot open your Account or process  orders for you if we do not collect your name and contact details. 

1) Opening Your Account 

When you open with us an Account or amend any information of your Account,  we may collect your Personal Information, such as your name, email address,  username and password. 

2) Visit TravX-R Platforms, Making Purchases for the Services or Products on the  platforms 

1. a) When you visit TravX-R Platforms, make purchases for any Services or  Products, we may collect and process certain information (which may  contain your Personal Information or may contain non-personally  identifiable information but nevertheless linked to your Personal  Information) including but not limited to those set out below:  
2. i) Copies of correspondence (whether by e-mail, instant or personal  messaging or otherwise) between you and us, and between you and  the Vendors; 
3. ii) Details of your usage of TravX-R Platforms (including traffic data,  location data and length of user sessions); 

iii) Feedback on and responses to surveys conducted by TravX-R relating to the Services and newsletters which may be published,  circulated or distributed by TravX-R; 

1. iv) Information automatically collected and stored in our server or the  server of our third-party services provider by using or accessing to  TravX-R Platforms (including the log-in name and password for your  User Account, your computers Internet Protocol (IP) address, browser  type, browser information, device information (including unique device  identifier), pages visited, previous or subsequent sites visited). 
2. b) When you use your mobile devices to visit TravX-R Platforms, we may  collect information about you and your mobile device as stated above. This 

can include location information if you have consented and configured your  mobile device to send us such information or upload photos with location  information to TravX-R Platforms. Such location information will be used in  the ways and for the purposes as stated in this Privacy Policy. For example,  we may use your location to suggest nearby Services during your travel or  provide personalised content. You can change your mobile device’s privacy  settings at any time to deactivate the function of sharing location  information. Please note some features of TravX-R Platforms may be  affected if you turn off such location sharing function. Should you have any  enquiries about your mobile devices’ privacy settings, we recommend you  contacting your mobile services provider or the manufacturer of your device. 

Storage of Information 

∙ The Personal Information and other data we collect from you may be transferred to,  processed, and stored in our servers or the servers of our third-party product providers.  Your Personal Information will be stored as long as is necessary to fulfil any of the  purposes described in this Privacy Policy, or to comply with any (i) contractual  requirement that are necessary for the provision of the Products; and (ii) legal, tax or  accounting requirement. 

∙ When it is no longer necessary for us to process your Personal Information, we will  either delete or anonymise the data or, if this is not possible (for example, because  your personal information has been stored in backup archives), then we will securely  store your Personal Information. We will endeavour to anonymise or aggregate your data if we intend to use it for  analytical purposes or trend analysis. 

∙ TravX-R will use reasonable endeavours to maintain appropriate physical, electronic  and organisational procedures to ensure that your Personal Information and other data  is treated securely and in accordance with this Privacy Policy, and to protect such data  against unauthorised access or unauthorised alteration, disclosure or destruction of  data. 

∙ Once we have received your information, we will use strict procedures and security  features to try to prevent unauthorised access. TravX-R does not give any  representation, warranty or undertaking that the Personal Information you provide to us  will be secured at all times, and to the extent TravX-R has fulfilled its obligations under  no circumstances shall TravX-R be responsible for any losses, damages, costs and  expenses which you may suffer or incur arising from unauthorised access to or use of  your Personal Information. 

∙ All payment transactions carried out by us or our chosen third-party provider of  payment processing services will be encrypted using online encryption technology.  You are responsible for keeping your chosen password confidential and not to share  your password with any third party.

Usage of Information 

∙ We process the Personal Information collected in as far as necessary for performance  of the contract with and providing Services to you. In addition, we process the other  Personal Information collected on the basis of our legitimate interests, which are the  further improvement of the Services and for direct marketing purposes. For example,  TravX-R will use Personal Information and other data collected through TravX-R Platforms or when making purchases for the Services and Products to create your  Account, to provide you with the Services, to continually improve TravX-R Platforms  and the Services, and to contact you in relation to the Services. This includes using  your Personal Information or such other data to achieve faster purchase requests,  better customer support and to provide you with timely notice of new Services and  special offers. 

∙ From time to time, we may make use of your Personal Information to contact you for  feedback on your use of TravX-R Platforms, to assist us in improving TravX-R Platforms, or to offer special savings or promotions to you, where you have indicated  your consent to receiving such communications. If you would prefer not to receive  notices of special savings or promotions, you may simply opt-out from receiving them  by replying to us through the hyperlink provided in these notices.  

Disclosure of Information 

∙ We may from time to time share and disclose your Personal Information and other data  to third parties, some of whom may be located outside your home country. The  circumstances under which such sharing and disclosure will take place may include,  without limitation, the following: 

1) To successfully complete your purchases or otherwise implement our Terms of  Service. We may share your information with Vendors or third parties who deliver  or provide goods and services or otherwise act on our behalf. 

2) If you are the Operator, to any visitor in connection with the Services you are  offering. 

3) To our third-party service providers (including Google Analytics), which we  engage amongst others for the performance of certain services on our behalf,  such as web hosting services, data analysis, marketing, market research, and to  otherwise provide you with customer service. 

4) If and to the extent required by any applicable law, order of court or requests by  any governmental authority to make such disclosure. 

5) Within the TravX-R Platforms. In case of a corporate transaction, in connection  with the sale, merger, acquisition, or other corporate reorganization or restructuring of our corporation, your Personal Information may be disclosed,  shared or transferred to the new controlling entity or its authorised third party for  carrying on our business. 

6) To our advisors, agencies or other parties concerned in order to protect the rights  and property of TravX-R. 

7) In any other case, to any third parties with your prior written consent (and in  which case we will make it possible for you to withdraw your consent as easily as  it was to provide consent).  

∙ We may also share aggregate or anonymous information with relevant third parties,  including our advertisers. Such information does not contain any Personal Information  and will not identify you personally. However, in some occasions, these third parties  may possess information about you or obtain your information from other sources.  When they combine such information with our aggregate information, they may be able  to identify you personally. 

∙ There may be links present on TravX-R Platforms which could result in you leaving  TravX-R Platforms and/or being taken to other third-party websites. You should note  that any Personal Information that you provide to these third-party websites are not  subject to this Privacy Policy, and TravX-R is not liable for any losses, damages, costs  or expenses which you may suffer or incur in connection with you providing or making  available Personal Information or other data to such third-party websites. 

∙ If you link, connect, or login to the TravX-R Platforms with a third-party service (e.g.,  Google, Facebook, WeChat), you direct the service to send us information such as  your registration, friends list, and profile information as controlled by that service or as  authorized by you via your privacy settings at that service. 

∙ You acknowledge, consent and agree that TravX-R may access, preserve and disclose  your Personal Information or other data if required to do so by law or pursuant to an  order of a court or by any governmental or regulatory authority having jurisdiction over  TravX-R or in a good faith belief that such access preservation or disclosure is  reasonably necessary to: 

1. a) comply with legal process; 
2. b) comply with a request from any governmental or regulatory authority having  jurisdiction over TravX-R; 
3. c) enforce the TravX-R Terms of Service or this Privacy Policy; 
4. d) respond to any threatened or actual claims asserted against TravX-R or other  claim that any data violates the rights of third parties; 
5. e) respond to your requests for customer service; or 
6. f) protect the rights, property or personal safety of TravX-R, its users and/or the  public.

Rights to access, correct or erase of Personal Information 

∙ You may at all time access, correct or erase your Personal Information by sending your  request by email at [insert]. 

∙ Where mandatory under applicable legislation, you may also request restriction of  processing of your Personal Information by sending your request or objection by email  at [insert].  

∙ When handling any of these requests described above, we have the right to check the  identity of the requester to ensure the person entitled to make the request. 

∙ We reserve the right to refuse to correct your Personal Information in accordance with  the provisions as set out in Privacy Laws, where they require and/or entitle an  organisation to refuse to correct Personal Information in stated circumstances. 

Refund Policy 

∙ Unless otherwise specified, video purchases either Tours or Runs will not be provided  any refunds. You will not be able to cancel or request for refund once payment has  been accepted. After payment has been made, you as the user will be able to view the  purchased video as many times as you like without needing to make any further  payments. 

Fulfilment Policy 

1. Purchase Confirmation

1.1 Purchases from TravX-R 

1.1.1 Through these Platforms, you may make purchases from TravX-R for the  Services offered. After you have made payment for your purchases, Services  are stated to be subject to instant confirmation. You will receive an email  confirmation (“Purchase Confirmation”) of your purchase that will contain an  Order Id number (“Order Id”) available for your viewing without limits. 

1.1.2 Purchase Confirmations can be confirmation of one-time purchases of Videos  for the use of both tours and runs (“Tours and Runs”) offered by TravX-R on  various destinations, which will be available for viewing without limits. The  Videos may be viewed in the content library.

1.2 Purchases from Vendors 

1.2.1 After you have made payments for your purchases from the Vendors, TravX R will inform the Vendors when TravX-R or the Vendors receive your  payments. Unless otherwise agreed with TravX-R, the Vendors should then  make the necessary arrangements to have the purchased item delivered to  You and provide details such as the name of the delivery company, the  tracking number, etc. to You through the TravX-R Platforms. 

1.2.2 You understand that the Vendors will bear all risk attached to the delivery of  the purchased item(s) and warrants that the Vendors have or will obtain  adequate insurance coverage for the delivery of the purchased item(s). In the  event where the purchased item(s) is damaged, lost or failure of delivery  during the course of delivery. You acknowledge and agree that TravX-R will  not be liable for any damage, expense, cost or fees resulted therefrom and  You and/or the Vendors will reach out to the logistic service provider to  resolve such dispute. 

2. TravX-R’s Rights and Obligations

2.1 TravX-R reserves the right to deny and cancel purchases of any Services that are  deemed in violation of this policy. Such a determination is at TravX-R’s sole  discretion. 

2.2 TravX-R reserves the right to require additional payment of fees or charges for any  Services offered by TravX-R. You shall pay all applicable fees or charges, as  described on these Platforms in connection with such Services selected by you. 

2.3 TravX-R reserves the right to change its price list for fees or charges at any time,  upon notice to you, which may be sent to you by email or posted on these Platforms.  Your use, or continued use, of the Services offered by TravX-R following such  notification constitutes your acceptance of any new or revised fees or charges. 

3. For Cross-Border Transaction

3.1 You understand and acknowledge that, where a product listing states that the  product will ship from overseas, such product is being sold from Vendors based  outside of Malaysia, and the importation and exportation of such product is subject to  local laws and regulations. You should familiarise yourselves with all import and  export restrictions that apply to the designating country. You acknowledge that  TravX-R cannot provide any legal advice in this regard and agrees that TravX-R shall not bear any risks or liabilities associated with the import and export of such products  to Malaysia.
